These terms and conditions (the “Terms”) govern your access to and use of ClearPlot AI (“ClearPlot”, the “Service”), a product operated by The Green Republic LTD. By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1.Who we are

2.The Service

ClearPlot provides land and site intelligence reports on parcels of land in the United Kingdom. A report may include ownership and title information, planning history, comparable planning decisions, environmental constraints, indicative remediation cost ranges and a residual valuation, combined into a single assessment (a “Report”).

Reports are compiled from public records, licensed datasets and automated analysis. Coverage is expanding over time, and we may not be able to produce a Report for every parcel. Where we do not hold sufficient data to produce a full Report, we will tell you before you pay.

3.Reports are not professional advice

You should obtain independent professional advice (for example from a planning consultant, solicitor, surveyor or accountant) before making any decision to buy, sell, develop or invest in land. Any decision you take on the basis of a Report is made at your own risk.

4.Waitlist and accounts

You may register your interest in ClearPlot by joining our waitlist. When you do so, we will contact you about the launch of the Service and related updates. You can unsubscribe at any time. Our handling of your personal information is described in our Privacy Policy.

If accounts become available, you are responsible for keeping your login details secure and for all activity that takes place under your account.

5.Pricing and payment

• The price of a single Report is £99 unless otherwise stated at the point of purchase. Prices are inclusive of VAT where applicable.
• We confirm that we hold enough data to produce a full Report on your chosen parcel before you are charged. If we cannot, you pay nothing.
• Payment is taken at the time of purchase through our third-party payment provider. We do not store your full card details.
• Because a Report is a digital product prepared and delivered to you on demand, it is generally non-refundable once delivered, except where required by law or where the Report was not delivered as described.

6.Accuracy and third-party data

We take reasonable care to compile Reports from reliable sources. However, much of the underlying information originates from third parties and public records that we do not control, and it may contain errors, omissions or be out of date. We do not warrant that any Report is complete, accurate or fit for a particular purpose, and estimates, predictions and valuations are indicative only.

7.Acceptable use

You agree not to:

• use the Service for any unlawful, fraudulent or harmful purpose;
• resell, redistribute, scrape or systematically extract Reports or data from the Service without our written permission;
• attempt to gain unauthorised access to, interfere with, or disrupt the Service or its infrastructure; or
• use the Service in a way that infringes the rights of others or breaches any applicable law or regulation.

8.Intellectual property

The Service, including its software, design, text, branding and the format and presentation of Reports, is owned by or licensed to The Green Republic LTD and is protected by intellectual property laws. When you purchase a Report, we grant you a non-exclusive licence to use that Report for your own internal business or personal purposes. You may not remove any notices or present the Report as your own work.

9.Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

Subject to the above:

• we provide the Service and Reports on an “as is” and “as available” basis, and exclude all warranties not expressly set out in these Terms to the fullest extent permitted by law;
• we are not liable for any loss of profit, loss of business, loss of opportunity, or any indirect or consequential loss arising out of or in connection with your use of the Service; and
• our total liability to you arising out of or in connection with a Report will not exceed the amount you paid for that Report.

10.Third-party links and services

The Service may contain links to, or rely on, third-party websites and services. We are not responsible for the content, availability or practices of those third parties, and your use of them is at your own risk and subject to their own terms.

11.Changes to the Service and Terms

We may update the Service or these Terms from time to time, for example to reflect changes in the law or how the Service works. Where changes are material, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12.Suspension and termination

We may suspend or withdraw access to the Service, or terminate your access, if you breach these Terms or where we reasonably need to for legal, security or operational reasons.

13.Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them are governed by the laws of England & Wales. The courts of England & Wales will have exclusive jurisdiction, save that if you are a consumer you may also be entitled to bring proceedings in the courts of the part of the UK in which you live.
